Terms and Conditions

Effective for bookings and invoices issued from 16th August 2026

In brief
These Terms and Conditions explain how tuition, memberships and learning resources and programmes provided by Happy Hedgehog Learning work. They are intended to keep arrangements clear and fair for everyone. Please read them before booking or purchasing.

1. About Happy Hedgehog Learning

Happy Hedgehog Learning is the trading name of Joanne Adams, a sole trader based in England.

In these Terms and Conditions, “Happy Hedgehog Learning”, “I”, “me” and “my” refer to Joanne Adams. “You” and “your” refer to the parent, carer or purchaser entering into the agreement. References to communication “in writing” include email.

2. Accepting these Terms and Conditions

By booking tuition, paying an invoice, purchasing a product or membership, or asking for a service to begin, you agree to these Terms and Conditions.

A contract is formed when I confirm your booking or order. Acknowledgement that a form, enquiry, request or waiting list reservation has been received does not itself guarantee a place or create a contract.

You will be given access to these Terms and Conditions before or when the contract is confirmed. Please save a copy for your records.

3. Tuition arrangements

Tuition will take place on the day, at the time and in the format agreed with you. Sessions may be provided in person or online and may be one-to-one or in a small group.

Your child’s regular lesson time is reserved for them once the relevant invoice has been paid. It cannot be transferred to another child or family without my prior agreement.

The dates on each invoice show the sessions reserved for the month ahead. Please check them carefully and contact me promptly if you believe anything is incorrect.

I may recommend changes to the frequency, length or type of tuition if I believe a different arrangement would better meet your child’s needs. Any change will be discussed with you before it takes effect.

4. Trial period

New one-to-one tuition arrangements usually begin with a two-week paid trial period. This gives both the family and Happy Hedgehog Learning an opportunity to decide whether the arrangement is suitable.

If tuition ends during the trial period, you will only be charged for lessons already provided or started. Any unused, prepaid whole lessons will be refunded.

If tuition was booked online, by telephone or away from my business premises, the statutory cancellation information in section 13 may also apply.

5. Fees, invoices and payment

Tuition fees will be confirmed before tuition begins and whenever a fee changes. Happy Hedgehog Learning is not currently VAT registered, so VAT is not added to the stated fees.

Tuition is paid monthly in advance. Invoices are normally issued on or around the 16th of the preceding month and payment is due by the 30th of that month. For example, the September invoice is normally issued on or around 16th August and is due for payment by 30th August.

Payment reserves and confirms the lessons shown on the invoice. If payment has not been received by the deadline, your child's place may be offered to another family on the waiting list.

Please contact me promptly if you anticipate difficulty making payment. I may pause tuition, cancel your reservation or decline further bookings while an invoice remains unpaid.

Prices for memberships, programmes and learning resources will be shown on the relevant sales or information page at the time of purchase.

6. One-to-one tuition: holidays and missed lessons

Planned holidays

If your child will miss one-to-one tuition because of a planned holiday, you must notify me in writing no later than the 14th of the preceding calendar month. Monthly invoices are normally issued on or around the 16th. For example, notice of an absence during October must be received no later than 14th September.

Planned absences of up to two consecutive weeks will not be charged when the required notice is given. If notice is received after the deadline, the reserved lesson remains payable and cannot be credited, refunded or transferred.

Longer or frequent absences may make it difficult for me to continue reserving a regular lesson time. In these circumstances, I will discuss the available options with you. These may include a reasonable reservation fee, a change to online lessons or ending the regular booking with at least 14 days’ written notice.

Illness and other absences

If your child cannot attend because of illness, injury, school commitments or another personal circumstance, the lesson remains payable and will not normally be refunded, credited or transferred.

Where I have availability, I may offer an alternative session as a gesture of goodwill. Alternative sessions are not guaranteed and do not change the cancellation terms above.

7. Group tuition

Group tuition follows the Happy Hedgehog Learning term-time calendar provided to families (please note this may differ to your child's school term dates). A child’s place is reserved for them throughout the term, although fees may be invoiced monthly.

Fees remain payable if a child is absent from a scheduled group session, including illness, holidays, school events or other personal commitments. Missed group sessions cannot normally be refunded, credited, transferred or rearranged.

Group composition may change during the year. If a group can no longer run in its existing form, I will discuss suitable alternatives with the affected families.

8. If Happy Hedgehog Learning cancels a lesson

If I cancel an individual or group lesson because of illness, an emergency or another circumstance within my control, I will either:

- offer a suitable replacement lesson; or

- apply a credit to a future invoice or provide a refund.

I will tell you as soon as reasonably possible. I am not responsible for other costs or losses caused by a lesson cancellation.

If an event outside my reasonable control affects tuition, such as severe weather, power failure, widespread internet disruption, pandemic or government restrictions, I may offer online tuition, rearrange the session or provide a credit where appropriate.

9. Ending tuition

After any agreed trial period, either you or Happy Hedgehog Learning may end regular tuition by giving at least 14 calendar days’ notice in writing via email.

Lessons already reserved within the notice period remain payable. Any prepaid lessons scheduled after the notice period, and any unused credit remaining on your account, will be refunded within 14 days using an agreed payment method.

I may end tuition immediately or on shorter notice where there is serious or repeated inappropriate behaviour, non-payment, a safeguarding concern, a breakdown in trust, or another circumstance that makes continuing the arrangement unsafe or unworkable. Where appropriate, unused prepaid lessons will be refunded.

10. Online tuition

You are responsible for providing a suitable device, a reliable internet connection and an appropriate place for your child to take part in online tuition.

A responsible adult should be contactable during an online lesson. The child must not record, photograph or share any part of a session without prior written permission.

If a technical problem on your side prevents or significantly disrupts attendance, the session remains payable. If the problem is on my side and prevents the lesson from being delivered, section 8 will apply.

11. Memberships and learning programmes

The content, price, billing frequency, start date and minimum commitment, if any, will be explained on the relevant information or sales page before purchase.

When purchasing, you may choose to receive immediate access to the membership's digital content during the statutory 14-day cancellation period. By expressly requesting immediate access, you acknowlege that your statutory right to cancel the digital content will be lost once access has been provided. you begin accessing, streaming or downloading the content. This does not affect your statutory rights if the content is faulty, not as described or cannot be accessed because of a fault that Happy Hedgehog Learning is responsible.

Unless stated otherwise at the time of purchase, a monthly membership continues and is billed monthly until cancelled. You may cancel before the next payment is due, either through the membership portal or by emailing me. No further payments will be taken. Your membership and access to its content will continue until the end of the monthly period you have already paid for and will then end automatically. Payments already made are non-refundable, except where required by law.

Membership login details are for the purchasing household only and must not be shared outside that household. Resources may be downloaded or printed for that household’s personal educational use but must not be copied, resold, uploaded, distributed or used to teach other children commercially. Educational establishments wishing to use Happy Hedgehog Learning products or resources should contact Joanne Adams to discuss purchasing an appropriate licence.

I may add, update, reorganise or replace membership content as the programme develops, provided the overall service remains consistent with the description given when you purchased it.

12. Digital products and resources

Digital products and access links will be sent to the email address provided at purchase. You are responsible for checking that the address is correct and for contacting me if the product does not arrive.

Digital content must be as described, of satisfactory quality and fit for its stated purpose. Your statutory rights are not affected by these Terms and Conditions.

Where you ask for digital content to be supplied during the statutory 14-day cancellation period, I will ask for your express consent to immediate supply and your acknowledgement that you will lose the right to cancel once access or downloading begins.

Once digital content has been supplied with the required consent and acknowledgement, a refund will not be provided merely because you change your mind. This does not affect your rights if the content is faulty, not as described or cannot be accessed because of a problem for which Happy Hedgehog Learning is responsible.

13. Your statutory right to cancel

If you enter into a consumer contract online, by telephone or away from my business premises, you will normally have 14 days from the date the contract is made in which to cancel without giving a reason.

If you ask for a tuition service or other service to begin during that 14-day period, I may ask you to make an express request for early performance. If you then cancel during the 14-day period, you may be charged a proportionate amount for the service already provided up to the time you cancel.

The right to cancel a service ends once it has been fully performed, if you expressly requested early performance and acknowledged that the cancellation right would be lost on full performance.

The separate rules for immediately supplied digital content are explained in section 12.

To exercise a statutory cancellation right, email [email protected] with your name, the child’s name where relevant, the service or product being cancelled and a clear statement that you wish to cancel. Any refund due will be made within the period required by law.

14. Parent and pupil responsibilities

To help tuition run effectively, you agree to:

- provide accurate and relevant information about your child’s needs, education, health and any reasonable adjustments they may require;

- ensure your child arrives or logs in on time with the equipment and resources requested;

- support respectful behaviour and appropriate communication;

- tell me promptly about changes that may affect tuition or safeguarding; and

- avoid attending in person when your child has an infectious illness that could place others at risk.

Late arrival will not normally extend the scheduled finishing time. If a child is collected late from an in-person lesson, I will follow the contact and safeguarding arrangements held for that child. Repeated late collection may result in the tuition arrangement being reviewed or ended.

15. Progress and educational outcomes

I will provide tuition with reasonable care and skill and will adapt teaching in response to the information available to me.

Progress depends on many factors, including attendance, engagement, practice between lessons, the child’s starting point and support outside tuition. I cannot guarantee a particular school result, test score, examination outcome or offer of a school place.

16. Behaviour, safeguarding, photography and recording

Children, parents and carers are expected to communicate and behave respectfully. Aggressive, abusive, threatening, discriminatory or otherwise inappropriate behaviour will not be accepted.

I may pause or end a lesson or tuition arrangement if behaviour creates a safety, safeguarding or wellbeing concern. Where required, I may share relevant information with safeguarding authorities or other appropriate organisations in accordance with my legal and safeguarding responsibilities.

Photography, filming and the use of pupil work are governed by the separate Photography and Filming Policy and any consent choices you have made. No child will be used in promotional material without the appropriate consent.

17. Intellectual property

All teaching materials, videos, worksheets, downloads, website content and other resources created by Happy Hedgehog Learning remain my intellectual property unless stated otherwise.

Resources supplied to you are for the personal educational use of the named pupil or purchasing household. You must not reproduce, modify, share, sell, publish, upload or distribute them, or use them for commercial teaching, without prior written permission.

18. Problems and complaints

If you have a concern about tuition, a product or a service, please contact me as soon as possible so that I have an opportunity to put things right.

Services will be provided with reasonable care and skill. Nothing in these Terms and Conditions limits any legal rights or remedies that cannot lawfully be limited or excluded.

19. Liability

I am responsible for loss or damage that is a foreseeable result of my breach of these Terms and Conditions or my failure to use reasonable care and skill. I am not responsible for loss or damage that was not reasonably foreseeable.

I do not exclude or limit liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory consumer rights.

The services and resources are supplied for personal educational use. I am not responsible for business losses, loss of profit, loss of revenue or business interruption arising from their use.

20. Changes to services, fees or these Terms

I may occasionally need to change lesson arrangements, services, fees or these Terms and Conditions to reflect changes in the business, the law, technology or the services provided.

Where a change materially affects an ongoing tuition or membership arrangement, I will give reasonable notice before it takes effect. If you do not wish to continue after a material change, you may end the arrangement in accordance with the relevant cancellation terms.

21. Privacy

Personal information is handled in accordance with the Happy Hedgehog Learning Privacy Notice. Please read that notice for information about what is collected, why it is used, how long it is kept and your data-protection rights.

22. General legal terms

If any part of these Terms and Conditions is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

No person other than you and Happy Hedgehog Learning has any right to enforce this contract.

These Terms and Conditions and any contract between us are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction, subject to any mandatory consumer right to bring proceedings elsewhere within the United Kingdom.
